Terms of Use for Digital Goods

By purchasing, downloading, or using any digital file or artwork from The Tell Tale Art, you agree to the following Terms and Conditions. Please read them carefully before use.

 

 

1. Permitted Uses

Our designs are licensed for personal use and small-batch boutique sales only. This includes:

  • Creating physical products such as embroidery, apparel, or gifts for personal use or limited resale.

  • Selling up to 50 physical units per design within one (1) year of purchase.

  • Using our designs in handmade projects, DIY creations, and boutique product lines.

If you wish to produce more than 50 units, sell on a larger commercial scale, or continue using the design after one year, you must obtain an Extended Use License. Please contact us for details.

 

 

2. Prohibited Uses

You may NOT, under any circumstances:

  • Share, copy, trade, exchange, distribute, gift, or resell any file — in whole or in part — in any digital format.

  • Offer our designs as downloadable files or “design-for-placement” assets on any third-party print-on-demand or dropshipping platform (e.g., Redbubble, Spreadshirt, Templett, Printful, etc.).

  • Repackage, trace, digitize, or otherwise claim our artwork as your own.

  • Use our files as a base for new digital products intended for resale.

  • Use our artwork in ways that infringe upon third-party trademarks or copyrights.

 

 

3. Copyright, Fan Art, and Trademark Disclaimer

All designs are the intellectual property of The Tell Tale Art / The Tell Tale Moon LLC and are protected under U.S. and international copyright law.

Some designs may include parody, fan art, or satirical references to cultural themes. These designs are original artistic interpretations and are not intended to replicate or replace official, licensed, or copyrighted works of any other company or creator.

It is the customer’s responsibility to:

  • Verify whether any wordmarks, logos, phrases, or designs are trademarked in the category of products you intend to sell.

  • Avoid the use of any design in ways that may infringe upon trademark or copyright protections.

The Tell Tale Moon LLC is not responsible for legal claims resulting from misuse, trademark violations, or copyright infringement by third parties.

 

 

4. Updates, Retirements, and Availability

  • Designs may be updated, modified, or retired without prior notice.

  • Pricing, licensing terms, and availability are subject to change.

  • The version of these terms in effect at the time of purchase will apply to that purchase.

 

 

5. Refunds and Digital Delivery

All digital files are non-refundable once downloaded due to their intangible nature. Please refer to our Return & Exchange Policy for details.

If you experience a download issue, please contact us — we are happy to resend your files directly.

 

 

6. Legal Notice

By purchasing and downloading our digital designs, you acknowledge that you have read, understood, and agreed to these terms. Failure to comply with these terms constitutes a breach of license and may result in revocation of usage rights, legal action, and/or account termination.
