Informal Negotiations:

Binding Arbitration:
If unresolved, disputes will be resolved through binding arbitration in Bonneville County, Idaho, under the rules of the American Arbitration Association. You waive the right to a jury trial or class action.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim shall not exceed the amount you paid us, if any, for the product or service giving rise to the claim.
You agree to indemnify and hold harmless The Tell Tale Art, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Site or violation of these Terms.
By using the Site or contacting us electronically, you consent to receive communications from us electronically. Electronic communications satisfy any legal requirement that such communications be in writing.
These Terms constitute the entire agreement between you and The Tell Tale Art regarding your use of the Site. If any provision is held invalid, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision does not waive that right or provision.
